Magic Quill AI — Terms of Use (including Subscription Terms)
Welcome to Magic Quill AI (the "App"). These Terms of Use (the "Terms") govern your use of the App and related services provided by Magic Quill AI LLC ("Magic Quill AI," "we," "us," or "our"). By using the App, you agree to these Terms. If you are a parent or legal guardian enabling a child to use the App, you agree to these Terms on the child's behalf and represent that you have lawful authority to do so.

Relationship to Apple's EULA
Your use of the App is also governed by Apple's Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These Terms incorporate and supplement Apple's EULA. Where these Terms conflict with Apple's EULA, these Terms apply to the fullest extent permitted by law. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and the Apple EULA, with the right to enforce them.

Eligibility & Accounts
• The App is intended for children under the supervision of a parent or legal guardian. Children under 13 may use the App only with verified parental consent.
• Parents/guardians create and manage accounts and are responsible for all activity under their accounts.
• Keep your login credentials confidential and notify us immediately of unauthorized use.

Content; AI-Generated & User Content
• The App generates educational stories and content. We strive for child-appropriate results but AI-generated content may occasionally contain errors. Parents should supervise and can report issues to privacy@magicquillai.com.
• If you or your child create content (e.g., saved stories), you grant Magic Quill AI a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, and display such content solely to operate, maintain, and improve the App. You represent that you have the rights to grant this license and that your content does not violate third-party rights or laws.

Prohibited Conduct
You agree not to: (a) use the App unlawfully; (b) harass, harm, or impersonate others; (c) upload malicious code; (d) interfere with the App; (e) reverse engineer or attempt to extract source code; (f) use bots/automation to access the App; (g) share credentials or permit unauthorized access; (h) circumvent security or rate limits.

Intellectual Property
The App, including text, graphics, UI, logos, and software, is owned by Magic Quill AI and protected by intellectual property laws. Except as permitted by Apple's EULA and these Terms, you may not copy, modify, distribute, create derivative works of, publicly display, or exploit the App without our prior written consent.

Subscription Terms (Auto-Renewing)
Magic Quill AI offers auto-renewable subscriptions sold and billed by Apple via your Apple ID. Payment is charged to your Apple ID at purchase confirmation. Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends. Your account will be charged for renewal within the 24 hours prior to the end of the current period. You can manage or cancel subscriptions in Settings > [your name] > Subscriptions. "Restore Purchases" is available in-app.
Available Subscriptions (Titles • Length • Price • Per-Unit)
Current prices shown for the U.S. App Store (prices may vary by country/region and are subject to Apple's local pricing and taxes):
1. Master Storyteller Monthly • 1 month • $9.99/month
2. Master Storyteller Yearly • 12 months • $99.99/year (≈ $8.33/month equivalent)
3. Apprentice Monthly • 1 month • $6.99/month
4. Apprentice Yearly • 12 months • $69.99/year (≈ $5.83/month equivalent)
Entitlements: As of today, the Master tier provides up to 50 stories/day; the Apprentice tier provides up to 20 stories/day. Entitlements may evolve over time; any changes will be reflected in the App.
Free Trials: We do not offer a free trial at this time. If a trial is offered in the future, the terms will be shown clearly in-app and on the App Store purchase sheet before you confirm.
Refunds: Apple is the merchant of record. Refunds are handled by Apple according to App Store policies (see reportaproblem.apple.com). Magic Quill AI does not process refunds directly.
Price Changes: If Apple adjusts pricing for your region or if we change subscription pricing, you will be notified by Apple and given the choice to accept new pricing before the next renewal. If you do not agree, cancel the subscription before renewal.
Upgrades/Downgrades: Apple may prorate transitions between tiers consistent with App Store policies. Details are shown during the change flow in Settings > Subscriptions.

The Privacy Policy describes the data we collect (e.g., child first name, grade level, preferences, reading progress, parent email), how we use it (educational personalization, account management), and your rights (including parental consent and deletion). We do not use children's data for advertising or sell data to third parties.

Third-Party Services
We use third-party services only for core functionality:
• Apple / App Store for purchases and subscription management;
• Firebase (Google Cloud) for authentication, secure storage, and crash diagnostics;
• RevenueCat for subscription verification/entitlements;
• Google Gemini API to generate story content from prompts (we avoid sending personal identifiers).
Use of these services is subject to their terms and policies.

Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Educational outcomes vary; the App is not a substitute for professional instruction.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAGIC QUILL AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID TO US VIA APP STORE SUBSCRIPTIONS IN THE 12 MONTHS BEFORE THE CLAIM.

Termination
We may suspend or terminate access to the App (or certain features) immediately for violations of these Terms, suspected fraud, or legal requirements. You may stop using the App and cancel subscriptions at any time in Settings > Subscriptions; cancellation is effective at the end of the current period.

Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, excluding conflicts-of-law rules. Except where prohibited, disputes will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association in California, USA. Either party may seek injunctive relief in court for intellectual-property violations. Consumers in jurisdictions that restrict arbitration or require local law/venue retain any non-waivable rights.

We may update these Terms from time to time. Material changes will be posted at the URL below with a new "Last Updated" date. Continued use of the App after changes become effective constitutes acceptance.
